Woman in Nipawin assaults case set for preliminary inquiring hearing

A woman accused in three Nipawin assaults has elected to be tried in Melfort’s Court of Queen’s Bench in front of a judge alone.

Carline Bear, 28, appeared in Nipawin Provincial Court on Wednesday, May 29, where a preliminary inquiry hearing was set for Nov. 4 back in Nipawin. Bear did not have to enter a plea with her electing to be tried in Court of Queen’s Bench.

The preliminary inquiry hearing gives the defence a chance to test Crown’s evidence and hear testimony from witnesses to determine if there is sufficient evidence to proceed with trial.

Tyla Olenchuk, Crown prosecutor, told Judge Margaret Gordon the prosecution has 10 witness for the preliminary inquiry and expects the process to last a day.

Bear’s charges include break and enter, theft of a motor vehicle, robbery with firearm, aggravated assault, and assault with weapon.

The charges stem from an early morning incident in April where police responded to three assaults within Nipawin. RCMP said two of the assaults took place at the same residence hours apart from one another, while a third incident occurred at a different location. All three are believed to involve the same suspects.

Bear will be held in custody in the meantime.

Denied Bail

Bear’s co-accused, 24-year-old Nathaniel Crate, also appeared in Nipawin court on May 29 where Gordon denied him bail.

Due to a publication ban requested by Crate’s lawyer Todd Parlee, Gordon’s reasoning can’t be published.

Crate faces similar charges as Bear, along with obstructing a peace officer and possession of a break-in instrument. He’ll appear in Nipawin court on Oct. 21 for trial.

Nipawin RCMP told northeastNOW there’s still an arrest warrant out for the third party in the co-accused: 27-year-old Garrett Scott McCallum.
