Guilty plea entered in Lakeland flight case

One of four people arrested after a tense situation that occurred last fall north of Prince Albert, has taken responsibility for his crime.

Xavier Smith appeared by video when his case was discussed Tuesday morning at Prince Albert Provincial Court.

With respect to the incident from October, 2023, a guilty plea was entered by his lawyer Nicole Bree to a charge of evading police.

Prince Albert RCMP initially received a report of a suspicious car without plates driving on Wahpeton First Nation. Officers located the car and attempted a traffic stop, however the suspect fled.

Roughly two days later, Lakeland Enforcement and Protection Service advised RCMP they had observed the car on Highway 2 near Northside, and the occupants were attempting to pull a pick-up truck out of the ditch.

Officers responded and located the pick-up truck abandoned. The subsequent investigation determined the pick-up was stolen.

They located the car driving in the ditch at the side of the highway and attempted a traffic stop. It did not initially stop for police, but officers blocked it in and were able to arrest the four occupants without incident.

After further investigation, three occupants were released without charge and Smith, who was 23 at the time, was charged with flight from police and possession of property obtained by crime under $5,000.

The latter charge will upon sentencing be stayed by the Crown.

Smith also has other outstanding charges related to guns and a breach of a court condition. Guilty pleas were also entered to those and everything will be addressed together when Smith returns to court on May 8.

To assist the judge, a pre-sentence report has been ordered and Smith’s lawyer confirmed plans to canvass Gladue factors, as well as addictions issues and treatment options.
