Additional sentences laid after brawl outside Prince Albert night club

Two people involved in an alcohol fueled brawl outside a Prince Albert night club have been allowed to serve their one year sentences in the community.

Terrance Shier and Shantel Fizzard (Bonik) were among five people charged after the incident at Fuel Stop over a year ago that sent two members of the security staff to hospital.

Shier, who got involved to defend his son, punched two security guards, and entered a guilty plea to common assault. Fizzard, who was not a part of the initial group refused entry and whose involvement included kicking a fallen staff member twice in the head, entered guilty pleas to assault and assault causing bodily harm.

As per Thursday’s sentencing hearing at provincial court, they each received a 12-month conditional sentence order, which essentially means as long as they can abide by a number of conditions, they can stay out of custody. Those conditions include keeping the peace, curfews, abstaining from drugs and alcohol, and 80 hours of community service.

Reading from the agreed statement of facts, Crown Prosecutor MaryAnne Larson noted the incident was allegedly instigated by Shier’s son who did not want to pay the five-dollar cover charge.

A staff member who was knocked to the ground, was then kicked in the head before having his head slammed into the deck surface by another attacker. He suffered blunt force trauma and had to be transported by ambulance to hospital.

“He was in and out of consciousness,” Larson said.

Another staff member taken to hospital suffered a swollen jaw and swelling on his face. A third staff member suffered a large laceration on his forehead.

According to victim impact statements read in court, all three men have suffered long-term emotional damage, noting feelings of anxiety and constantly looking over their shoulder.

A video recording of the fight was posted to social media and viewed hundreds of times.

Noting the incident involved multiple people, who all could have easily walked away, Judge Schiefner who accepted the joint submission proposed by the lawyers involved, said he is required by law to denounce this type of behavior.

“Some poor choices were made on this day,” he said.

Another accused, Jordan McDougall, who was involved in the fight but left before the more serious injuries occurred, previously received a conditional discharge.

Dustin Shier, the man alleged to have instigated the incident, previously entered a guilty plea to assault but is now contesting the facts and arguing he acted in self-defence. An expungement hearing will likely occur at a later date.

Jonathan Mah, the man alleged to have slammed the staff member’s head into the ground, and like Fizzard was not a part of the original altercation, also has an outstanding charge for a separate offense involving flight from police. He is on bench warrant status.
