Nursing an arm in a sling and admitting to a three week stay in hospital after being struck by a vehicle, Warren Dalton fears he will never recover from a broken heart.

The 54-year-old made the comment Wednesday morning outside Prince Albert Provincial Court.

Nearly three months have passed since he and his girlfriend Amy Lariviere were struck by a vehicle when they crossed at the 1400 block of Second Ave. W. Both were taken to hospital but Lariviere passed away soon after.

“We were just trying to get across the street because we had a green light to go, and that person came out of nowhere and just took us out,” Dalton recalled.

A Prince Albert Police Service officer happened to be on patrol in the area and witnessed what he thought was a collision between a vehicle and two pedestrians. The driver of the black vehicle fled the scene.

Danielle Kitzan was arrested Oct. 13 and on Wednesday the Crown consented to her release with conditions that include living at a residence in Saskatoon, having no contact with the victim and no driving.

Dalton, who noted Lariviere had cancer and taught him about forgiveness, said he thinks about her everyday.

“You know it’s a tragic loss for me and a family, and I just want to see justice being done. I didn’t realize, even after her charges were read that she was going to walk free.”

Hertha Lariviere also attended court and said losing her sister has been hard.

“She was my life. She was my number one,” she said.

Hertha explained how she and Amy had grown up together in foster care and had lived in Prince Albert, Pinehouse and Weyakwin. Hertha also noted Amy had six children and two had previously passed away.

Members of Kitzan’s family were also in court.

In relation to the August incident, Kitzan was charged with operating a vehicle that was in an accident that failed to stay at the scene, resulting in death and the same charge again, but resulting in injury. Her next scheduled court date is Oct. 29.
