Jury selection no longer required for bus driver murder case

A man accused of robbing and killing a former Prince Albert city bus driver no longer wishes to be tried by a jury.

Kenny Morin, 21, appeared by video Tuesday at Court of Queen’s Bench and re-elected for a judge-alone trial. The original jury selection was made last October. The matter has now been adjourned for a pre-trial hearing on June 18.

The case itself dates back to March 15, 2020, when 61-year-old David Maxemiuk was attacked near his garage in the city’s Midtown area. A family member told paNOW he had just returned from a trip to the grocery store.

Morin was originally charged with aggravated assault in connection to the incident, but when Maxemiuk passed away in hospital five days later, the charge was amended.

Morin was also charged with stealing Maxemiuk’s wallet. There have been no pleas entered at this stage of the court proceedings.

The reasons for the change in re-election were not discussed in court and Morin’s lawyer Michael D. Nolin was not available for comment afterwards.

Due to restrictions related to preventing the spread of COVID-19, a number of scheduled jury trials in the province have been getting postponed. Those individuals wishing to possibly speed up the court process, have been given the option to make a re-election.
